General Terms and Conditions (T&C)

PRICES / TERMS OF DELIVERY
All prices in EURO, other prices on request. Subject to price changes, errors and delivery options. The prices in the latest publisher’s or price list apply; older prices become invalid with the publication of a new price list or catalogue.
Resellers (dealers) undertake to sell the goods to end customers in Germany, Switzerland and Austria only at the current catalogue prices and not to grant any discounts associated with the purchase. They must comply with the rules of the fixed price procedure for the book trade and the music trade. Pricing is based on the exchange rate of the respective currency:
Member states of the European Union: the EURO price applies as the fixed price.
The publisher grants dealers a customary discount on all products for resale. Wholesalers receive a higher discount on all publishing products.

SHIPPING RISK
Shipping is at the expense and risk of the customer. The goods are dispatched with the usual commercial protection.

DESPATCH / CHARGES
Delivery on behalf of ZebeMusic by Südost Service GmbH as a letter, consignment of goods, book shipment, small parcel or postal parcel (DHL/Deutsche Post).
The shipping costs are a flat rate of € 3,00 (abroad € 6.00).
Free delivery inner Germany from an order value of € 40.00 (abroad € 75.00).

PAYMENT / RESERVATION OF TITLE
The publisher may request advance payment from new customers; a pro forma invoice will be sent to the customer in advance.
The goods remain the property of the publisher until full payment has been received.

DUE DATE
The due date stated on the invoice shall apply; if this is not stated, payment must be made within 30 days of the invoice date. Special rebates and discounts are not granted.

RIGHT OF WITHDRAWAL

The following right of cancellation applies to orders placed by consumers:

CANCELLATION POLICY

Right of cancellation:

You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.
To exercise your right of cancellation, you must contact our sales department (Südost-Service GmbH, Tel.: +49-8581-960 50
Fax: +49-8581-754, order@zebemusic.com) of your decision to cancel this contract. The cancellation can be made informally. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right of cancellation before the cancellation period has expired.

Consequences of cancellation:

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.
You must return or hand over the goods to us immediately and in any case within fourteen days at the latest from the day on which you inform us of the cancellation of this contract. The deadline is met if you dispatch the goods before the period of fourteen days has expired.
You shall bear the direct costs of returning the goods. You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, properties and functionality.

Exclusion of the right of cancellation:

The right of cancellation does not apply to contracts for the delivery of sealed audio or video recordings if you have unsealed the delivered data carriers.

EXCHANGE, COMPLAINT
The exchange of goods is generally excluded. This does not apply to faulty goods. Returns must be made within 2 weeks of dispatch. Returns must be made in the cheapest possible way. Replacement goods will be delivered free of charge. As a matter of principle, only proper goods will be delivered, i.e. no defective items at reduced prices.
Exceptions for dealers:
Deliveries with a right of return, e.g. consignment deliveries, can be requested before or together with the order. In this case, the goods must be returned undamaged within the specified period. The liability risk is borne by the orderer / customer.
If the publisher asks a retailer to accept goods on consignment, the publisher shall bear the risk and the corresponding standard or agreed shipping costs.

JURISDICTION
The place of jurisdiction is Berlin or the court nearest to the location of the publisher.
